GENERAL TERMS AND CONDITIONS OF SALE

These conditions apply to orders placed from their update date.
Article 1 - Subject Matter
These General Terms and Conditions of Sale govern sales made on alehprod.com by ALEH PRODUCTION.
The website sells, in particular, digital content related to photography and content creation, including Lightroom presets and associated files.
Any order implies acceptance of these GTC.

Article 3 - Customers
The products may be purchased by individuals and professionals.
They may be marketed in France and internationally, subject to any applicable legal, tax, or technical restrictions.
Article 4 - Digital Products
Each product sheet presents the main characteristics of the product sold.
The packs may notably include:
- presets - XMP files - DNG files - installation guides - other digital files indicated on the product page
The exact content of the pack is that which is indicated at the time of the order.
The before/after examples are provided for illustrative purposes. The result obtained may vary depending on the photograph, lighting, equipment, settings, software used, or color profile.
Article 5 - Price
Prices are displayed in euros.
The applicable price is the one displayed at the time the order is confirmed.
ALEH PRODUCTION may change its prices at any time, without affecting orders already confirmed.
Any applicable taxes are determined in accordance with current regulations.
Article 6 - Order
The client selects the products they wish to purchase then confirms their order.
Before payment, they can check the ordered product and its price.
The final confirmation of the order results in a payment obligation.
The client is responsible for the accuracy of the email address provided.
Article 7 - Payment
Payments are processed by Stripe.
The available payment methods are those offered at the time of checkout.
ALEH PRODUCTION does not directly store the client's full credit card number.
An order is considered paid only after confirmation of payment by Stripe.
Article 8 - Promotional codes
ALEH PRODUCTION may offer promotional codes.
These codes may be subject to various conditions:
- validity period - products concerned - maximum number of uses - limit per customer - percentage discount or fixed amount
Unless otherwise indicated, several promotional codes are not cumulative.
Article 9 - Digital delivery
After confirmed payment, the customer gains access to the purchased digital product.
The download is carried out by means of a secure and temporary link generated for the relevant order.
The files remain stored privately and do not have a permanent public address.
The customer may make several downloads of the purchased product.

Article 10 - Licence for use
The purchase of a product grants the customer a personal licence for use.
The client may use the files:
- for their own creations - for their personal photographs - in the course of their professional activity - on works created for their own clients
It is forbidden to:
- resell the files - share the files with a third party - redistribute the files free of charge - publish the files on a download platform - market the pack under another name - modify the files for the purpose of reselling or redistributing them
Article 11 - Right of withdrawal
Consumers generally have a period of 14 days to exercise their right of withdrawal for a distance contract.
In accordance with Article L221-28, 13° of the Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not on a tangible medium where performance has begun after the consumer's prior express consent and express waiver of their right of withdrawal.
Before payment, the customer ticks a box, unticked by default and mandatory to proceed, by which they request immediate access to their digital product after payment and acknowledge that, as soon as it is made available, they will no longer be able to exercise their right of withdrawal. This consent is recorded with the date, time, order and version of the accepted text, and then confirmed in the order confirmation email, sent on a durable medium when the content is made available.
Due to the digital nature of our products and their immediate availability after purchase, sales are considered final as soon as the digital content is made available, immediately after payment confirmation, subject to the customer's prior express consent, their acknowledgment of the loss of the right of withdrawal and the confirmation required by law.
As soon as the digital content is made available, immediately after payment confirmation, and provided that the customer has previously given express consent, acknowledged the loss of their right of withdrawal and received the confirmation required by law, no refund can be granted for a simple change of mind.
This policy does not affect the consumers' statutory rights and guarantees.
Article 12 - Withdrawal request
As long as the digital content has not been made available, or if the legal conditions for the loss of the right of withdrawal are not met, the consumer may exercise their right of withdrawal within the legal period of 14 days.

The request must identify the relevant order and clearly express the consumer's wish to withdraw.
Article 13 - Refund
When a withdrawal is validly exercised within the legal time limit, the refund shall be made in accordance with applicable regulations.
The customer may also contact ALEH PRODUCTION in case of:
- double payment - incorrect payment - corrupt file - inaccessible download - wrong product - technical problem
ALEH PRODUCTION may in particular provide a new secure link or a functional file when this allows the problem to be resolved.
Article 14 - Compatibility
The customer must check the compatible formats and software indicated on the product sheet.
ALEH PRODUCTION cannot be held liable for any incompatibility resulting from the use of software or a version not indicated as compatible.
This clause does not limit the consumer's statutory rights.
Article 15 - Intellectual property
Digital content shall remain protected by the rules relating to copyright and intellectual property.
The purchase of a pack corresponds solely to the granting of a right of use.
Article 16 - Personal Data
Data processing is described in the Privacy Policy available on the website.
Article 17 - Complaints
All complaints must first be sent to:

ALEH PRODUCTION will seek to resolve the dispute directly with the customer.
Article 18 - Consumer Mediation
In the event of an unresolved dispute following a prior complaint, the consumer may have recourse free of charge to the consumer mediator designated by ALEH PRODUCTION.

Article 19 - Applicable Law
These GTCs are governed by French law.
For a consumer residing in another country, the mandatory protection rules from which they may benefit in their country of residence remain applicable.
The French version shall constitute the reference version.
